Ceton vs. Gibson Lawsuit
Just saw this when I was searching if CETON was doing anything new at CES 2014.
http://investing.businessweek.com/resea ... =100504084
and this
http://www.tennessean.com/article/20131 ... ker-system
Someone was looking for a phone number before, perhaps this helps? Did not know about the Gibson stuff? Am I the only one?

Wow, that is very interesting. Not only that ceton is moving in that direction, but also that they are getting sued for a whole lot of money... if the echo issues couldn't defund the company, this certainly couldnt be good...
On a familiar note, it appears that ceton "delayed and failed to perform." Sigh.

When the news stops coming out of an organization, as it has with Ceton, that is usually a sure sign it is going down the tubes. This is just icing on the cake.

You have all assumed, absent any facts whatsoever, that:
a) simply by bringing suit, Gibson is right
b) Ceton is therefore wrong
c) the judge will award every bit of damages that Gibson demands
On the other hand, it could very well be that Gibson failed to protect itself and Ceton found an avenue in the contract to do exactly what they've done.

From the counter-sue article:
"Gibson's suit is a clear example of a large multi-national company trying to use the courts to litigate a smaller company into submission," Ed Graczyk, chief marketing officer for Ceton, said in an email.
The first proof of life we've seen from Ceton in a long while! How exciting. Too bad it's kind of a pathetic, woes-me legal argument. I will say that none of this would appear on the surface to be a good thing for Ceton. And talk about a crappy early Christmas present this must have been ...

Please understand that I can't coment on pending litigation either way, but if you would like to see the actual legal documents of the suit that Ceton filed against Gibson, it is available at http://cetoncorp.com/counterclaimtcc wrote:ceton in the news

I imagine that would be the last thing people are interested in hearing about from Ceton.

^umm I dunno. It's good entertainment, no offence to Ceton.
Gibson are waving their big booty around so its refreshing to see a small company like Ceton fire back and publicly at that.

Thanks for stopping by to share your legal argument. Slightly better than total silence, I guess.erkotz wrote:Please understand that I can't coment on pending litigation either way, but if you would like to see the actual legal documents of the suit that Ceton filed against Gibson, it is available at http://cetoncorp.com/counterclaimtcc wrote:ceton in the news

Well, this doesn't look good for Ceton no matter how you slice it. The best they can probably hope for is just to have the lawsuit tossed out or withdrawn. They'd probably still end up paying fairly hefty legal fees, plus they'd probably have an awfully hard time finalizing and marketing whatever they've been working on for the last 6 months without opening the door to another lawsuit.
$950k over 6 months is probably a decent chunk of change for a company Ceton's size. That probably reflects a sizable portion of Ceton's development efforts for the last 6 months. That's probably why we've seen next to nothing come out of the company since then.
It sounds like Ceton really got screwed over here, but I don't see how this can end well for them.

^ its called a counter suit and they are doing it. If the court rules in favour of Ceton all expenses will be taken care of. Plus some...

Yeah, and monkeys may fly out of my butt. Keep living in that naive world. The only folks that will make out in this deal are the lawyers.STC wrote:If the court rules in favour of Ceton all expenses will be taken care of. Plus some...

I don't get your sarcasm. Ceton believe that there isn't a contract as put forward by Gibson to sue over. That's pretty basic stuff. If that is the case their counter sue will be for damages. True the lawyers make money but that's how the legal system works unfortunately.
